Police: Franklin Teen Supplied Alcohol, Committed Rape While Out on Bail in Another Sexual Assault Case


FRANKLIN, Pa. (EYT) — A Franklin teen has been charged with rape and other sexual offenses after police say he provided alcohol to an child and had sex with the victim while the juvenile was intoxicated.

According to court documents and an affidavit of probable cause filed by Sugarcreek Borough Patrolman Matthew Johnson, Brady Michael Cubitt, 18, of Franklin, is accused of engaging in a sexual relationship with the juvenile victim earlier this month at a residence in the borough.

The investigation began when the juvenile’s parent brought the child to the Sugarcreek Borough Police Department, according to the complaint. The alleged victim was reportedly interviewed with the parent’s permission and told officers that the victim and Cubitt drank alcohol together at the residence. Police said the victim reported being very intoxicated and that Cubitt had sex with the victim. The victim also stated that Cubitt had provided the alcohol, the complaint noted.

The complaint said a witness corroborated the alleged victim’s account and additionally told police that Cubitt made sexual advances toward the witness as well.

Cubitt was arraigned on July 15 before Magisterial District Judge Patrick E. Lowrey and is currently being held in Venango County Prison on $25,000 monetary bail after being unable to post bond.

He is facing the following charges:

  • Rape of a Substantially Impaired Person (Felony 1)
  • Statutory Sexual Assault: 4-8 Years Older (Felony 2)
  • Aggravated Indecent Assault – Complainant Less Than 16 (Felony 2)
  • Unlawful Contact with Minor – Sexual Offenses (Felony 2)
  • Corruption of Minors – Defendant Age 18 or Above (Felony 3)
  • Indecent Assault – Person Less Than 16 Years of Age (Misdemeanor 2)
  • Sell/Furnish Liquor to a Minor (Misdemeanor 3)

A preliminary hearing is scheduled for July 23 at 10:30 a.m. in Venango County Central Court.

These charges come after Cubitt was held for court in April on previous felony charges involving alleged sexual contact with a 13-year-old. In that case, he was released on $20,000 unsecured bail following charges of statutory sexual assault-4-8 years older, aggravated indecent assault-comp. less than 16, indecent assault person less than 16, unlawful contact with a minor-sexual offenses, and corruption of minors. He is also facing multiple conspiracy charges in a separate terroristic threats case.
